1. Agreement
By downloading or using any NeonIndigo app ("the App"), you agree to be bound by these terms and conditions. If you do not agree, do not download or use the App.
2. Licence
Subject to these terms, NeonIndigo grants you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control. Your use of the App is also subject to the Apple Standard End User Licence Agreement, which is incorporated into these terms by reference.
3. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in any way that violates applicable laws or regulations
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
- Use the App in any way that could damage, disable, overburden, or impair our services or infrastructure
- Attempt to gain unauthorised access to any part of our systems
4. No Warranty
The App is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by applicable law, NeonIndigo disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of bugs or viruses, or that defects will be corrected.
5. Limitation of Liability
To the fullest extent permitted by applicable law, NeonIndigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the App — even if we have been advised of the possibility of such damages.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
6. Third-Party Services
The App may integrate with or rely on Apple platform services (such as the App Store and CloudKit). Your use of those services is governed by Apple's own terms and privacy policies, not these terms.
7. Updates
We may update the App, or update these terms, at any time. The "last updated" date at the top of this page will always reflect the most recent version. Continued use of the App after a change to these terms constitutes your acceptance of the revised terms.
8. Termination
We reserve the right to suspend or terminate your licence to use the App at any time, with or without cause, and without prior notice.
9. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
